What is Domestic and Family Violence Leave?

At Thorne Harbour Health, we know how important it is to support LGBTIQ+ individuals facing domestic and family violence. Recent updates to the Fair Work Act ensure that employees are entitled to 10 days of paid leave annually to address such situations. Here’s what you need to know about your rights and available support.
What is Family and Domestic Violence Leave?
Family and Domestic Violence Leave is a provision under the Fair Work Act that allows employees to take time off to deal with the impacts of family and domestic violence. This can include:
- Making arrangements for their safety or the safety of a close relative
- Attending court hearings
- Accessing police services
- Going to counselling sessions
- Moving to a safer place
Who is Entitled to Family and Domestic Violence Leave?
All employees, including full-time, part-time, and casual workers, are entitled to this leave. The 10 days of leave renews every year and doesn’t accrue from year to year.
How to Apply for Leave:
Notify your line manager as soon as possible, even if you need to start the leave immediately. Employers might ask for evidence like police reports, court documents, or a statutory declaration.
Confidentiality and Privacy:
Employers must keep any information you provide about your leave confidential. This means they can’t use it for anything other than arranging your leave or protecting your safety.
